Terms & Conditions of Sale

These Terms & Conditions (“Terms”) apply to all purchases made through our website www.strathearncheese.com. Please read them carefully before placing an order. By ordering from us, you agree to be bound by these Terms.

 

1. Orders

  • All orders are subject to availability.

  • We may refuse or cancel an order if:

    • The product is out of stock.

    • Payment is not authorised.

    • We suspect fraud or misuse.

    • There is an error in pricing or product description.

 

2. Products

  • Our cheeses are handmade and may vary slightly in size, shape, or appearance.

  • Product descriptions, images, and prices are provided in good faith, but minor variations may occur.

 

3. Pricing and Payment

  • Prices are shown in GBP (£) and include VAT where applicable.

  • Delivery charges are added at checkout.

  • Payment must be made in full at the time of order. We accept credit/debit card payments and Apple Pay via our secure payment providers.

  • We do not store full payment card details.

  • If we discover an error in pricing, we are not obliged to fulfil the order at the incorrect price. We may cancel the order or contact you to confirm whether you wish to continue at the correct price.

 

4. Delivery

  • We deliver to addresses within the UK only.

  • Delivery times are estimates only. While we aim to dispatch orders promptly, we are not liable for courier delays or events outside our control.

  • It is your responsibility to provide accurate delivery details and ensure someone is available to receive your order.

  • If you request that an order be left in a safe place or with a neighbour, we are not responsible for any loss, damage, or spoilage once the courier has delivered as instructed.

 

5. Risk and Ownership

  • Risk of loss or damage passes to you once the order has been delivered to the address provided.

  • Ownership of goods passes to you only once full payment has been received.

 

6. Returns and Refunds

  • Due to the perishable nature of cheese, orders are not subject to the statutory 14-day cooling-off period under the Consumer Contracts Regulations.

  • We cannot accept returns of opened or partially consumed products.

  • If your order arrives damaged, incorrect, or spoiled, please contact us within 24 hours of delivery at Ben@strathearncheese.com with your order details and, if possible, photographs.

  • Where appropriate, we will offer a replacement or refund.

7. Allergens and Food Safety

  • Our cheeses contain milk and may contain other allergens. Full allergen information is available on request.

  • Once delivered, you are responsible for storing products safely and in accordance with the instructions provided.

 

8. Liability

  • We are not liable for:

    • Spoilage or damage caused by incorrect storage after delivery.

    • Delays or failures caused by events outside our reasonable control (see Force Majeure clause).

    • Any indirect, incidental, or consequential loss.

  • Nothing in these Terms excludes or limits our liability for death, personal injury, or fraud caused by our negligence.

 

9. Force Majeure

  • We are not responsible for any failure or delay in performing our obligations caused by circumstances beyond our reasonable control, including (but not limited to) strikes, labour disputes, natural disasters, pandemics, courier disruptions, or extreme weather.

 

10. Your Rights

  • These Terms do not affect your statutory rights under UK consumer law.

 

11. Governing Law

  • These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
